Por\u00e9m, a contrata\u00e7\u00e3o nestes casos deve ter as seguintes caracter\u00edsticas: \u00a0ser intermitente, peri\u00f3dica ou sazonal.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Sob este aspecto, a Lei da Terceiriza\u00e7\u00e3o torna a contrata\u00e7\u00e3o de tempor\u00e1rio proibida nos casos de substitui\u00e7\u00e3o de trabalhadores em greve, salvo nos casos previstos em lei.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00c9 imprescind\u00edvel, para fins legais, que o motivo da contrata\u00e7\u00e3o esteja expl\u00edcito em seu contrato de trabalho.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">O que deve constar em um contrato de trabalho de funcion\u00e1rio tempor\u00e1rio?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Ainda segundo a lei, todo tempor\u00e1rio deve ser contratado por meio de um contrato por escrito. Este contrato dever\u00e1 estar dispon\u00edvel nos casos de fiscaliza\u00e7\u00e3o pelos agentes do Minist\u00e9rio do Trabalho.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">No contrato de servi\u00e7o dever\u00e3o constar as seguintes informa\u00e7\u00f5es:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">I &#8211; qualifica\u00e7\u00e3o das partes;<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">II &#8211; motivo justificador da demanda de trabalho;<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">III &#8211; prazo da presta\u00e7\u00e3o de servi\u00e7os;<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">IV &#8211; valor da presta\u00e7\u00e3o de servi\u00e7os;<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">V &#8211; disposi\u00e7\u00f5es sobre a seguran\u00e7a e a sa\u00fade do trabalhador, independentemente do local de realiza\u00e7\u00e3o do trabalho.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Al\u00e9m disso, o contrato com o mesmo empregador n\u00e3o pode ultrapassar 180 dias (6 meses) de validade, sejam os dias consecutivos ou n\u00e3o. No entanto, o contrato poder\u00e1 ser prorrogado por mais 90 dias al\u00e9m do prazo estipulado originalmente.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Caso a empresa contratante desejar contratar o mesmo tempor\u00e1rio novamente, dever\u00e1 esperar o prazo de 90 dias ap\u00f3s a rescis\u00e3o do contrato para poder celebrar um novo contrato. Se a contrata\u00e7\u00e3o ocorrer antes de 90 dias do t\u00e9rmino do contrato anterior, o v\u00ednculo empregat\u00edcio estar\u00e1 caracterizado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Outro ponto importante sobre o <\/span><a href=\"https:\/\/www.oitchau.com.br\/blog\/tipos-de-contrato-de-trabalho-reconhecidos-pela-clt\/\"><span style=\"font-weight: 400;\">contrato de trabalho<\/span><\/a><span style=\"font-weight: 400;\">\u00a0 \u00e9 que neste tipo de contrata\u00e7\u00e3o, o tempor\u00e1rio n\u00e3o precisa cumprir um contrato de experi\u00eancia, como consta nas Consolida\u00e7\u00f5es das Leis do Trabalho.<\/span><\/p>\n<p><span data-sheets-value=\"{&quot;1&quot;:2,&quot;2&quot;:&quot;\n\t\t&lt;!--HubSpot Call-to-Action Code --&gt;\n\t\t&lt;span class=&quot;hs-cta-wrapper&quot;
