Al\u00e9m do prazo previsto neste artigo, somente por ordem judicial poder\u00e1 ser retido qualquer documento de identifica\u00e7\u00e3o pessoal.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> 2\u00ba &#8211; Quando o documento de identidade for indispens\u00e1vel para a entrada de pessoa em \u00f3rg\u00e3os p\u00fablicos ou particulares, ser\u00e3o seus dados anotados no ato e devolvido o documento imediatamente ao interessado.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Art. 3\u00ba Constitui contraven\u00e7\u00e3o penal, pun\u00edvel com pena de pris\u00e3o simples de 1 a 3 meses ou multa de NCR$ 0,50\u00a0 a NCR$ 3,00, a reten\u00e7\u00e3o de qualquer documento a que se refere esta Lei.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0<\/span> <span style=\"font-weight: 400;\">Par\u00e1grafo \u00fanico. Quando a infra\u00e7\u00e3o for praticada por preposto ou agente de pessoa jur\u00eddica, considerar-se-\u00e1 respons\u00e1vel quem houver ordenado o ato que ensejou a reten\u00e7\u00e3o, a menos que haja , pelo executante, desobedi\u00eancia ou inobserv\u00e2ncia de ordens ou instru\u00e7\u00f5es expressas, quando, ent\u00e3o, ser\u00e1 este o infrator.<\/span><\/p><\/blockquote>\n<h3><span style=\"font-weight: 400;\">O que n\u00e3o pode estar no checklist?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A empresa pode sofrer multa, processos trabalhistas e penalidades, caso exija do colaborador documentos que pode causar discrimina\u00e7\u00e3o e comprometer a candidatura da vaga em quest\u00e3o.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00e3o poder\u00e1 ser exigido:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exame de HIV;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exames de gravidez;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Registros de quita\u00e7\u00e3o de d\u00edvidas ou de endividamento, como certid\u00e3o negativa no SPC e Serasa;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dados de antecedente criminal;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Documento que comprove que o colaborador nunca entrou com a\u00e7\u00f5es trabalhistas de outras empresas.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\u00c9 necess\u00e1rio que a empresa n\u00e3o solicite esses itens aos colaboradores, pois n\u00e3o s\u00e3o autorizados pela lei.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Gostou do conte\u00fado?
