Confira.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">O que \u00e9 o Art. 62 da CLT?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">\u00c9 a lei que define em quais aspectos n\u00e3o h\u00e1 necessidade do empregador, pagar horas extras e adicionais noturnos aos colaboradores,<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\"><br \/>\n<\/span><b>Art. 62 <\/b><span style=\"font-weight: 400;\">&#8211; N\u00e3o s\u00e3o abrangidos pelo regime previsto neste cap\u00edtulo: (Reda\u00e7\u00e3o dada pela <\/span><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8966.htm\"><span style=\"font-weight: 400;\">Lei n\u00ba 8.966<\/span><\/a><span style=\"font-weight: 400;\">, de 27.12.1994)<\/span><\/p>\n<p><b>I<\/b><span style=\"font-weight: 400;\"> &#8211; os empregados que exercem atividade externa incompat\u00edvel com a fixa\u00e7\u00e3o de hor\u00e1rio de trabalho, devendo tal condi\u00e7\u00e3o ser anotada na Carteira de Trabalho e Previd\u00eancia Social e no registro de empregados;\u00a0<\/span><\/p>\n<p><b>II<\/b><span style=\"font-weight: 400;\"> &#8211; os gerentes, assim considerados os exercentes de cargos de gest\u00e3o, aos quais se equiparam, para efeito do disposto neste artigo, os diretores e chefes de departamento ou filial.\u00a0<\/span><\/p>\n<p><b>III<\/b><span style=\"font-weight: 400;\"> &#8211; os empregados em regime de teletrabalho.\u00a0<\/span><\/p>\n<p><b>Par\u00e1grafo \u00fanico<\/b><span style=\"font-weight: 400;\"> &#8211; O regime previsto neste cap\u00edtulo ser\u00e1 aplic\u00e1vel aos empregados mencionados no inciso II deste artigo, quando o sal\u00e1rio do cargo de confian\u00e7a, compreendendo a gratifica\u00e7\u00e3o de fun\u00e7\u00e3o, se houver, for inferior ao valor do respectivo sal\u00e1rio efetivo acrescido de 40% (quarenta por cento).<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Por\u00e9m, se os aspectos trabalhistas n\u00e3o est\u00e3o inclusos nessas regras do\u00a0 Art. 62 da CLT, e a empresa n\u00e3o efetuar o pagamento ou ocorrer atrasos, podem sofrer processos trabalhistas e se complicar a credibilidade diante os funcion\u00e1rios.<\/span><\/p>\n<h3><strong>Quando deve ser pago a hora extra e adicional noturno?<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">Quando a carga hor\u00e1ria do colaborador \u00e9 igual a 8 horas di\u00e1rias e 40 horas semanais, e caso exceda 2 horas do dia de trabalho deve receber a hora extra, pois estar\u00e1 exercendo a fun\u00e7\u00e3o ap\u00f3s o hor\u00e1rio combinado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">O valor da hora extra equivale a 50% a mais do valor da hora normal, por exemplo, se um colaborador recebe R$10,00 por hora, deve-se somar a 1,5 que resultar\u00e1 no valor da hora extra de R$15,00.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">J\u00e1 o adicional noturno \u00e9 v\u00e1lido para colaboradores que atuam no per\u00edodo das 22 horas \u00e0s 5 horas, por ser considerado o hor\u00e1rio da madrugada, e o valor da hora adicional \u00e9 de 20% sob a hora, seguindo o exemplo anterior, o colaborador receberia R$12,00 pelo adicional.<\/span><\/p>\n<h4><strong>Como funciona o pagamento de horas no Teletrabalho?<\/strong><\/h4>\n<p><span style=\"font-weight: 400;\">Continua sendo aplicado o Art. 62 da CLT mesmo em contrata\u00e7\u00f5es de teletrabalho, por\u00e9m a defini\u00e7\u00e3o desse tipo de contrata\u00e7\u00e3o consta no <\/span><a href=\"https:\/\/www.jusbrasil.com.br\/topicos\/173000266\/artigo-75a-do-decreto-lei-n-5452-de-01-de-maio-de-1943\"><span style=\"font-weight: 400;\">Art. 75<\/span><\/a><span style=\"font-weight: 400;\"> que cita:<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\"><br \/>\n<\/span><b>Art. 75<\/b><span style=\"font-weight: 400;\">-B. Considera-se teletrabalho a presta\u00e7\u00e3o de servi\u00e7os preponderantemente fora das depend\u00eancias do empregador, com a utiliza\u00e7\u00e3o de tecnologias de informa\u00e7\u00e3o e de comunica\u00e7\u00e3o que, por sua natureza, n\u00e3o se constituam como trabalho externo.\u00a0<\/span><\/p>\n<p><b>Par\u00e1grafo \u00fanico<\/b><span style=\"font-weight: 400;\">. O comparecimento \u00e0s depend\u00eancias do empregador para a realiza\u00e7\u00e3o de atividades espec\u00edficas que exijam a presen\u00e7a do empregado no estabelecimento n\u00e3o descaracteriza o regime de teletrabalho.\u00a0<\/span><\/p>\n<p><b>Art. 75<\/b><span style=\"font-weight: 400;\">-C.
